Environmental Approvals

One of the primary functions of the Marine Environment Protection Authority (MEPA) is to develop and implement a framework to prevent, reduce, and manage pollution in the marine environment caused by ship-based and shore-based activities. MEPA is empowered to safeguard and preserve Sri Lanka’s territorial waters, maritime zones, foreshore, and coastal areas from pollution arising from any such activities.

Any new development activity carried out in these areas must obtain approval from MEPA to ensure that the proposed development does not pose a risk of pollution to the marine environment.

When to Obtain Approvals from MEPA:

Approvals from MEPA are required for:
Any project or activity implemented within Sri Lanka’s territorial waters, maritime zones, foreshore, or coastal areas.
Any changes, improvements, or modifications to an already approved project or activity within the above-mentioned zones.

Approvals must also be obtained in the following scenarios:

  • If an Environmental Impact Assessment (EIA) or Initial Environmental Examination (IEE) identifies significant impacts on the coastal or marine environment.
  • If the project-approving agency considers MEPA approval as a prerequisite for granting its own approval.
  • If MEPA determines that the proposed or ongoing project poses significant risks to the coastal or marine environment.
  • If local authorities or environmental inspection committees identify potential risks to the coastal or marine environment.
  • If the project proponent or developer anticipates a significant impact on the coastal or marine environment, they must submit a formal request for environmental approval. This request should be addressed to the Chief Executive Officer of the Marine Environment Protection Authority (MEPA).

How to Apply for MEPA Approval:

The following documents must be included with the request:

  • EIA or IEE Report (if applicable).
  • If no EIA or IEE is required, a detailed report outlining the project, activity, or operation.
  • Copies of approvals obtained from other relevant agencies, if available.

MEPA’s Decision-Making Process:
Granting Clearance
  • If MEPA is satisfied with the submitted information and the proposed mitigation measures effectively address environmental risks, clearance will be granted.
  • The approval may include specific conditions that the applicant must fulfill to complete the approval process.
Request for Additional Information
If the submitted information is insufficient, MEPA will request further details about the project or activity.
Conducting Field Inspections:
MEPA may decide to conduct a site inspection. A team of MEPA officials will inspect the site and submit a report to the Chief Executive Officer, who will make a decision based on the findings.
Not Granting Clearance:
If the environmental impact is significant and mitigation measures are deemed inadequate, MEPA will not issue the clearance.

All decisions will be communicated to the applicant in writing.

Charges (fee) for Clearance Letters:

MEPA charges fees for issuing clearance letters, with costs varying based on the need for site inspections:

  • For clearance letters requiring inspections: Rs. 2,000.00 and an inspection fee will be charged. The inspection fee will cover transportation, officer costs, any necessary boat rentals.
  • For clearance letters without inspections: A standard fee of Rs. 2,000.00 will be charged.

This fee structure ensures transparency and aligns with the resources utilized during the approval process.
